You agree that Arciom Farm Service shall not be liable to you or to any third party for any claim or loss related to you and arising out of such modification, suspension, or discontinuance of the Service.

Your access to and use of the Website and/or services signifies that you have read, understand, and agree to be bound by these Terms, whether you are or are not a registered user of Arciom Farm Service, and is subject to your compliance with these Terms. Your continued use of the Website and/or services constitutes your acceptance of and agreement with any and all such changes. In addition, Arciom Farm Service may post additional terms, conditions, rules, or requirements related to the Website and/or services. All such terms, conditions, rules, or requirements are or will be incorporated by reference into these Terms, and you agree to be bound by and subject to them. At its sole discretion, Arciom Farm Service may also offer other services or features governed by different terms & conditions.

Arciom Farm Service Inc. operates in Belarus and Moldova, offering farm equipment and agricultural products to both local and international markets. We connect farms with high-quality equipment and produce to ensure efficient and sustainable farming practices.

We supply a wide range of farm equipment and products within Belarus and Moldova, while also reaching global markets. Our offerings are backed by years of industry experience and a commitment to providing durable and reliable tools for farmers. Our services include supplying essential farm equipment, seeds, fertilizers, and other agricultural products designed to help farms thrive.

Our role in transactions is straightforward: we facilitate the sale of farm equipment and agricultural products, ensuring both quality and satisfaction. As part of our service, we handle the logistics of delivering equipment and products to farms within Belarus, Moldova, and internationally.

Payments for products and services are processed securely, and we ensure a smooth transaction experience. By maintaining transparency and a commitment to customer satisfaction, we ensure that all parties involved are satisfied with the outcome of their transactions.

AGE VERIFICATION

By registering as a user, you certify that you are 13 years of age or older. Children under the age of 13 may not become users of Arciom Farm Service Inc., and parents or legal guardians may not agree to these Terms on their behalf. Arciom Farm Service Inc. reserves the right to remove any content at its discretion, with or without notice. SALES, CUSTOM, AND VALUE-ADDED TAXES

To comply with consumer legislation, we encourage both our farmers/agro-merchants and customers to remain in good standing regarding applicable customs and value-added taxes (VAT).

Due to varying tax jurisdictions, purchases made by end customers may be subject to specific sales, customs, or value-added taxes, which are the responsibility of the buyer. Additionally, shipping time and associated costs may increase based on tax regulations. When placing an order on our website, you, as the importer of agricultural products or items, must fully comply with the laws and regulations of the destination country.

HOW TO PURCHASE

Purchasing from Arciom Farm Service Inc. is quick and simple:

  1. Choose the farm produce, equipment, or products you wish to buy.
  2. Select your preferred variant (size, bundle, etc.).
  3. Click “Add to Cart.”
  4. Choose the quantity (the default quantity is 1).
  5. Click “Buy” and proceed to the next step.
  6. Input your personal details and shipping information.
  7. Double-check your information and confirm your order.
  8. Enter your payment information (card number, expiration date, and CVV code). Rest assured, your card data is encrypted and processed securely by our payment system.
  9. Once your payment is completed, our representative will receive your order details within 3 hours. You may cancel the order within this 3-hour window if you change your mind.
REFUND TERMS

You are entitled to a full refund if:

  • The product you received is significantly different in quality from the description on our website (e.g., the item is defective, damaged, or the information provided in its description turns out to be substantially incorrect, and you are unable to use the product properly).
  • If the product meets the above conditions, please return it to the farmer/agro-merchant. Be sure to contact our customer support team to confirm the return address before returning the product. Arciom Farm Service Inc. reserves the right to reject refund requests if the return address is not confirmed. Only after our support team receives proof of the return shipment will a refund be considered. We aim to respond to all refund requests within 43 hours of receiving them.

The following products cannot be returned unless they are received defective:

  • Products that are not suitable for return due to health protection or hygienic reasons if unsealed after delivery, or those inseparably mixed with other items after delivery.
  • Farm products made to your specifications or clearly personalized, especially handmade items.
  • Products that may deteriorate or expire rapidly.
  • Products damaged due to negligence, misuse, or activities other than their intended purpose are not returnable.

Please note that Arciom Farm Service Inc. does not cover the shipment costs for returns.

HOW TO REQUEST A REFUND

There are several ways to request a refund:

  1. If less than 3 hours have passed since you made your purchase, you can cancel your order and receive a full refund. Simply go to “My Orders,” select the order you want to cancel, and tap the “Order Cancellation” button at the bottom of the order page.
  2. If the product you received is significantly different in quality (defective, damaged, or substantially incorrect in description), go to “My Orders,” select the order you want to request a refund for, and tap “Product Related Issues.” Follow the prompts to complete your refund request.
REFUND PROCESS

Refunds will be processed only to the card used for the original purchase. We strive to complete the refund process for valid claims within 14 days, though our usual processing time is between 2-3 days. If your refund claim is approved, it will be credited to your account promptly.

WARRANTY DISCLAIMER

Arciom Farm Service Inc. and its licensors or suppliers make no representations or warranties regarding any content provided or accessed through our Service. We will not be held responsible or liable for the accuracy, copyright compliance, legality, or decency of the materials available through our platform.

We (along with our licensors and suppliers) do not provide warranties or guarantees about the suggestions or recommendations for products and services offered or purchased through our platform. Products and services purchased through Arciom Farm Service Inc. are provided “AS IS” without any warranties, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free.

The Service and all content are provided by Arciom Farm Service Inc. (and its licensors and suppliers) on an “AS-IS” basis, with no warranties of any kind.

LIMITATION OF LIABILITY

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, as well as for fraud or fraudulent misrepresentation.

However, to the fullest extent allowed by applicable law, under no circumstances and under no legal theory (including, without limitation, tort, contract, or statutory duty) shall Arciom Farm Service Inc. (or its licensors or suppliers) be liable to you or any other party for:

  • Any damages resulting from your selection, use, or inability to use the Website or Service.
  • The suitability of the information, content, agricultural merchandise, or experiences provided via the Website.
  • Any indirect, special, incidental, exemplary, punitive, or consequential damages, including but not limited to loss of profits, sales, business, revenue, goodwill, reputation, or anticipated savings, work stoppage, or computer failure.
INDEMNITY

To the fullest extent allowed by applicable law, you agree to indemnify and hold Arciom Farm Service Inc., its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorneys’ fees) arising from or in any way related to any third-party claims relating to (a) your use of the Service (including any actions taken by a third party using your account), and (b) your violation of these Terms. In the event of such a claim, suit, or action (“Claim”), we will attempt to provide notice of the Claim to the contact information we have for your account. However, failure to deliver such notice will not eliminate or reduce your indemnification obligations.

ASSIGNMENT

You may not assign, delegate, or transfer these Terms or your rights or obligations, or your Service account, in any way (by operation of law or otherwise) without Arciom Farm Service Inc.’s prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent.

CHOICE OF LAW & JURISDICTION

These Terms and your use of the Service will be interpreted in accordance with the laws of Belarus and Moldova, and all claims and disputes (including non-contractual claims and disputes) arising out of or in connection with your use of the Service will be determined in accordance with the laws of these jurisdictions.

OTHER TERMS

You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Service, provided that Arciom Farm Service Inc. may, at its sole discretion, handle any of the foregoing on your behalf or for itself as it sees fit.

The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect.

You and Arciom Farm Service Inc. agree that these Terms are the complete and exclusive statement of the mutual understanding between you and Arciom Farm Service Inc. and that it supersedes and cancels all previous written and oral agreements, communications, and other understandings relating to the subject matter of these Terms.

You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Arciom Farm Service Inc., and you do not have any authority to bind Arciom Farm Service Inc. in any respect whatsoever.

DISPUTE RESOLUTION
Mandatory, Bilateral Arbitration and Waiver of Class Actions.

Please read this carefully. It affects your rights. YOU AND ARCIOM FARM SERVICE INC. AGREE THAT ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF, OR RELATING TO YOUR USE OF THE SERVICE, ANY PRODUCTS OR SERVICES SOLD OR DISTRIBUTED BY OR THROUGH THE SERVICE, THIS AGREEMENT, OR ANY CONTENT AND/OR USER SUBMISSION (PUBLIC, PERSONAL AND/OR LIMITED AUDIENCE) ON THE SERVICE SHALL BE RESOLVED ONLY BY FINAL AND BINDING, BILATERAL ARBITRATION.

“Disputes” shall include, but are not limited to, any claims or controversies between you and Arciom Farm Service Inc. related to or arising from the Service, the Content, any Submission, including but not limited to claims or controversies concerning sales, returns, refunds, cancellations, defects, policies, privacy, advertising, or communications between you and Arciom Farm Service Inc., even if the claim arises after termination of the Service or your user account. Disputes also include, but are not limited to, claims that: (a) you bring against our employees, agents, affiliates, or representatives; (b) Arciom Farm Service Inc. brings against you; (i) claims in any way related to the relationship between you and Arciom Farm Service Inc., whether based on contract, tort, statute, fraud, misrepresentation, advertising claims, or other legal theories; (ii) claims arising from prior Terms with Arciom Farm Service Inc.; (iii) claims subject to ongoing litigation where you are not a party or class member; and/or (iv) claims that arise after termination of these Terms.

DISPUTE NOTICE

Before initiating arbitration, you and Arciom Farm Service Inc. agree to first provide each other with a written notice (“Notice of Dispute”), which should include: (a) a written description of the issue and relevant documents and supporting information; and (b) a statement of the specific relief sought. A Notice of Dispute sent to Arciom Farm Service Inc. should be addressed to: Arciom Farm Service Inc., Belarus, Moldova, or via email to info@arciomfarms.com. Arciom Farm Service Inc. will send a Notice of Dispute to you using the email address associated with your Arciom Farm Service account. Both parties agree to attempt to resolve the dispute within 45 days after receiving the Notice of Dispute and not to begin arbitration until the 45-day resolution period has passed. If no agreement is reached within this period, either party may begin the arbitration process.

We agree that all dispute resolution proceedings will occur on an individual basis and not as part of a class or representative action. Unless both you and Arciom Farm Service Inc. agree otherwise, the arbitrator may not consolidate claims from multiple parties. If this prohibition on class, representative, or consolidated arbitration is found to be unenforceable, the entire arbitration provision shall be void.

If a claim proceeds in court instead of arbitration, both parties waive their right to a jury trial.

BY AGREEING TO THESE TERMS, YOU UNDERSTAND AND AGREE THAT YOU AND ARCIOM FARM SERVICE INC. ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION FOR ANY CLAIMS COVERED BY THIS AGREEMENT.

The arbitrator may only award declaratory or injunctive relief in favor of the individual party seeking relief and only to the extent necessary to provide that party with the relief warranted by their individual claim.

ARBITRATOR’S DECISION

An arbitrator’s award will be a written statement detailing the disposition of each claim, along with a concise written statement outlining the essential findings and conclusions that form the basis of the award. The arbitrator’s decision and award will be final and binding, subject to limited court review as allowed by applicable law, and judgment on the award may be entered in any court with competent jurisdiction.

SMALL CLAIMS & GOVERNMENT ACTIONS

As an alternative to arbitration, you or Arciom Farm Service Inc. may resolve disputes in a small claims court that has jurisdiction over the claim. These Terms and this arbitration agreement do not prevent you from bringing a dispute to the attention of any federal, state, or local government agency. Such agencies can, if permitted by law, seek relief against Arciom Farm Service Inc. on your behalf.

INTELLECTUAL PROPERTY RIGHTS ON ARCIOM FARM SERVICE INC.

Arciom Farm Service Inc. respects the intellectual property rights of others. We prohibit listing counterfeit products or items to which we do not own the rights.

If you believe your intellectual property rights are being infringed upon, please report it to us. When filing your report, please include the following:

  • The type of infringement (e.g., trademark infringement or counterfeit products).
  • A clear identification of the copyrighted work or trademark you claim has been infringed.
  • A link or description of the material that you believe is infringing and its location on Arciom Farm Service Inc. (for example, URLs to the infringing product).
  • Information sufficient for us to contact you, such as your name, address, telephone number, and email address.
  • A statement, made in good faith, that the material in question has not been authorized by the copyright or trademark owner or their agent, or in accordance with applicable law.
  • A statement made under penalty of perjury that the information provided is accurate and that you are the copyright or trademark owner or authorized to act on their behalf.

Please note that only the copyright or trademark owner or their authorized representative may file a report of infringement. If you believe that items on Arciom Farm Service Inc. are infringing the rights of others, you may want to inform the rights owner.
